How to file for bankruptcy online in Metro Atlanta and North Georgia
Are looking for a website that enables you to file a bankruptcy petition after you have filled out a questionnaire and pressed “submit”? Stop looking! There is no such thing!
If you are filing your own bankruptcy in Georgia, you cannot file your case online. You must go to the relevant division of the Bankruptcy Court (typically based on your county of residence) and file your case there. On the other hand, attorneys admitted to the bankruptcy courts in Georgia typically file their cases online. This is because attorneys have access to the federal court system’s electronic case filing. Although lawyers can file bankruptcy cases online, they are still required to meet with you in person. They have to give you an adequate explanation of your bankruptcy options and personally witness your signatures on the bankruptcy petition. So you can’t file a case over the phone, via fax, email, or internet. You also can’t give power of attorney to someone else to sign the bankruptcy petition on your behalf. There has to be at least one in person meeting with the lawyer.
Having access to an online case filing system called “ECF” is very convenient for lawyers. As a bankruptcy lawyer, I find the court’s online filing system very helpful for many reasons. For example, bankruptcy cases can be filed online at any time, even after the Bankruptcy Court has closed or on weekends. This is a particularly important benefit of the electronic case filing system, since people having to file for bankruptcy are facing garnishments, judgments, repossessions and foreclosures and can’t wait until the courthouse opens.
