341 Meeting of Creditors Bankruptcy Hearing Information for Chapter 7 Filers

When you file a Chapter 7 Bankruptcy case, you are scheduled to attend a mandatory appearance known as your Meeting of Creditors. Your appearance at this Meeting is required and your creditors may attend as well. At this Meeting of Creditors, you will be placed under oath by your Chapter 7 Trustee who will then ask you a series of questions. You will be represented by your attorney at this Meeting. One of the questions your Chapter 7 Trustee will ask you is whether you reviewed the Bankruptcy Infomation Sheet prepared by the Office of the U.S. Trustee. Everyone filing a Chapter 7 Bankruptcy is required to review a copy of this Bankruptcy Information Sheet. You received a copy of this document when you met with the attorney. In the event you have misplaced this Information Sheet, here it is for Download.

You must bring two pieces of identification with you to your Meeting of Creditors. This identification must be original and not copies. You must bring:

  1. A Government-issued picture ID, such as a valid driver's license, military ID card, or passport; AND
  2. Proof of your Social Security number, such as your actual Social Security card, an original W2 form or 1099 form.

It is also a great idea to bring with you a copy of your latest federal income tax returns (the 1040 Form) to the 341 meeting of creditors of your bankruptcy case. Always consult with your bankruptcy attorney a couple of days before the hearing, as you may have to bring additional documents to the hearing. For example, you may have to bring your bank statements, or your property tax statement.

If you and your spouse are filing your case together, both of you are required to attend this meeting and both of you are required to bring your Government-issued picture ID and proof of your Social Security number.

ATLANTA DIVISION

If the address you provided to your bankruptcy attorney is located in one of the following Georgia counties, then You need to go to the Atlanta Division of U.S. Bankruptcy Court for the Northern District of Georgia.

NEWNAN DIVISION

If the address you provided to your bankruptcy attorney is located in one of the following counties, then the Newnan Division of U.S. Bankruptcy Court for the Northern District of Georgia is going to administer your case.

Carroll, Coweta, Fayette, Haralson, Heard, Meriwether, Pike, Spalding, Troup
